This eBay Billing Agreement ("Agreement") is between PayPal (Europe) S.à r.l. & Cie, S.C.A. ("PayPal"), eBay, Inc. and/or its subsidiary companies (collectively, “eBay”) and you.
PayPal is only a party to this Agreement for the sole purpose of the sections "Your Instruction to PayPal" and "Your Cancellation Rights" below. eBay is acting as agent for your chosen carrier and is authorised to conclude the sale of shipping services on its behalf.
By agreeing to these terms, you authorise eBay, to charge your PayPal account for the full amount of all fees owed to the chosen carrier service arising from its use (the "Authorised Amounts"). The Authorised Amount only comprises the costs of the postage labels and does not include any further fees incurred through the use of other eBay services with costs.
eBay may charge your PayPal account on a one-time, sporadic, or recurring basis.
You authorise and instruct PayPal to pay eBay all and any Authorised Amount debits as presented by eBay to PayPal. By providing such authorisation and instruction, you acknowledge and agree that in all circumstances you reasonably expect that:
You agree that PayPal is not obliged to verify or confirm the amount that eBay presents to PayPal for the purpose of processing payment of any Authorised Amount.
Your Cancellation Rights: You can review or cancel this Agreement by following the relevant instructions in the "Cancelling Recurring Payments" section of the PayPal User Agreement (or the instructions to review or cancel recurring payments as otherwise set out in the PayPal User Agreement from time to time). A cancellation received by PayPal before close of business on a business day will take effect on the next business day; if it is received after close of business on a business day, it will take effect on the business day after the next business day.
Cancellation by eBay: This Agreement may be cancelled by eBay at any time. Cancellation by eBay will take effect from the time that PayPal receives eBay’s instruction to cancel the Agreement.
Your continuing obligation: If this Agreement is cancelled for any reason, or if the payment of amounts owed through PayPal cannot be completed for any reason, you remain obligated to pay eBay for all unpaid amounts and eBay reserves the right to seek reimbursement through other means.
This Agreement is governed by English law. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or to enjoy the benefit of any term of this Agreement.
PayPal is deemed authorised and regulated by the Financial Conduct Authority. The nature and extent of consumer protections may differ from those for firms based in the UK. Details of the Temporary Permissions Regime, which allows EEA-based firms to operate in the UK for a limited period while seeking full authorisation, are available on the Financial Conduct Authority’s website.
