We have prepared a summary of the PayPal User Agreement that became effective on February 20, 2024 ("Agreement"). All capitalized terms in this summary shall have the meanings ascribed to them in the Agreement. This summary is intended only to highlight the main clauses of the Agreement applicable to your relationship with PayPal, but in no way replaces your own reading and evaluation. The Agreement is an important document, which you should carefully evaluate before deciding to become a PayPal user and use PayPal's services.
To be registered as a PayPal user, you must be at least 18 years old (in the case of individuals), be resident in Brazil, and have a valid registration with the Federal Revenue of Brazil (CPF or CNPJ). The Agreement applies only to users resident in Brazil.
By opening and using a PayPal account, you agree to all of the terms and conditions contained in the Agreement, the Privacy Statement, the PayPal Acceptable Use Policy, and any other terms and conditions contained on the Terms and Conditions page. Please also note that PayPal follows the procedures set forth in its Anti-Money Laundering and Counter-Terrorist Financing Policy.
PayPal may make changes to the Agreement and any of its policies from time to time. If the changes reduce your rights or increase your obligations, PayPal will inform you at least 30 days in advance.
PayPal is a payment institution issuer of e-money subject to supervision and regulation by the Central Bank of Brazil, pursuant to Law No. 12,865, of October 9, 2013, and a settler of a closed-loop payment scheme exempted from authorization, pursuant to the applicable regulation. PayPal (i) enrolls individuals and legal entities so that they become paying users (buyers), and can therefore send payments for products and/or services; and (ii) enables individuals and legal entities to become receiving users (sellers) and accept PayPal as a payment instrument in relation to the sale of products and/or services. PayPal manages users' accounts through the capture, transmission, data processing, and settlement of electronic transactions. The services of PayPal are not to be confused with private services and activities of financial institutions or insurance companies, such as banking, insurance, or foreign exchange services.
You can act either as a paying user, purchasing products, and/or services using the payment instruments linked to the PayPal Wallet, or as a receiving user, selling products and/or providing services. You can be a paying user and a receiving user simultaneously, depending on the activity performed in relation to a certain payment transaction.
PayPal reserves the right to terminate, suspend, or limit your access to your account or to PayPal services and/or limit access to the funds you receive if you violate the Agreement, the PayPal Acceptable Use Policy, or any other agreement you have entered into with PayPal. Such provision applies whether you are acting as a paying user or a receiving user.
PayPal offers three types of accounts: Personal Accounts, Premier Accounts, and Business Accounts. All PayPal accounts allow you to send and receive payments and make purchases online. If you are an individual with a valid CPF (Individual Taxpayer Identification Number), you can open a (i) Personal Account if you want to make purchases; or (ii) a Premier Account if you wish to receive payments. You can open a business account if you are a legal entity with a valid CNPJ and primarily want to use PayPal to sell products or services or receive donations. Business Accounts that have made transactions (sent or received payments) in the last 24 months are classified as Balance Business Accounts.
Only Balance Business Accounts will qualify as payment accounts as defined in Article 6, IV, of Law No. 12,865, of October 9, 2013 (and will be subject to such law and applicable regulation). More information about Balance Business Accounts can be found in the Balance Business Account Additional Terms and Conditions, which form part of the Agreement.

You are responsible for maintaining proper security and control of the usernames, passwords, personal identification numbers, or any other code you use to access your account and the PayPal services. You must provide correct and updated information in your PayPal account profile.
Pursuant to BACEN Circular No. 3,952/2019, if you act as a receiving user, using PayPal as a payment service provider, you: (i) must provide PayPal with information about the contracts entered into between you and non-financial institutions involving negotiation of your receivables; (ii) authorize PayPal to send such information, as well as your receivables schedule, to a receivables registration system; and (iii) authorize PayPal to perform the financial settlement of your receivables pursuant to the instructions provided by the registration system mentioned above. Please note that certain functionalities of your PayPal account may be temporarily unavailable under the Agreement.
You may close your PayPal account at any time, except as provided in the Agreement. In case of closure, PayPal will cancel all scheduled or incomplete transactions. If you are a Balance Business Account holder, you must withdraw or transfer any balance from your account before closing it. If you have a Personal or Premier Account and have funds receivable, you must add a bank account or payment account held by you to your PayPal Wallet before closing it so that we can transfer funds to your registered account. You may not close your account to evade an investigation if you have a pending transaction or an open dispute or claim, if you owe funds to PayPal, or if your PayPal account is subject to a hold, limitation or reserve.
PayPal may also close your account at any time due to breach of the Agreement, disagreement, lack of commercial interest, or the need to comply with applicable law and/or regulations, or if your account has been inactive for at least 30 days, upon submission of prior written notice and making any available funds held in your PayPal account accessible to you.
You will remain responsible for all obligations related to your account, even after its closure.
You can link or unlink a credit card or debit card to your PayPal Wallet as a payment method.
You may select any of the payment methods in your PayPal Account as your preferred payment method, unless the selected payment method cannot be used (such as if you select a credit card that has expired). In addition, the availability of certain payment methods may be limited based on a specific seller or the third-party website you are using to complete the transaction.
Personal or Premier accounts do not have a functionality for holding an e-money balance. Holders of these accounts must register a bank or payment account (of the same ownership) so that the payments received are transferred automatically. Usually, the transfer can take up to 3 business days. If you do not register a bank or payment account held by you within 30 days of receiving a payment, your account's payment functionality will be disabled until you register an account. In case of an international payment, we may reverse the transaction and return the amounts to the payer.
Balance Business Accounts can hold an e-money balance. When you receive a payment from abroad, the amount will be converted to Brazilian Reais at the time of the transaction. Currency conversions and exchange operations are carried out by duly authorized banks under the terms of the Agreement. Balances in Brazilian Reais may only be used to purchase products and/or services from sellers located in Brazil or to pay amounts due to PayPal, such as amounts due for refunds or chargebacks. More information about Balance Business Accounts, including the transfer of funds and restrictions on transfers or withdrawals, can be found in the Balance Business Account Additional Terms and Conditions, which form part of the Agreement.
You will not receive interest or other income on the amounts in your account, and you agree to assign your rights to any interest or earnings to PayPal.
You can send payments for the purchase of products and/or services or make donations, subject to any limits that PayPal may impose in relation to the quantity and value of payments, as set forth in the Agreement. If we allow you to send a payment to someone who does not have a PayPal account, the recipient can claim the funds by opening a PayPal account. If the recipient already has a PayPal account, they can refuse to accept the funds. In case of a refund, please refer to the Agreement for details, conditions, and applicable deadlines.
When transactions require a currency conversion, PayPal acts as a provider of international payments or transfer services (eFX) and engages an authorized financial institution to perform the currency conversion, and the exchange rate is determined based on the rates available in the market. The sending of payments for the acquisition of a product and/or service of a receiving user located abroad can only be completed with a card for international use. In this case, you can use the conversion rate obtained by PayPal or opt for the currency conversion performed by your card issuer, as set forth in the Agreement. In the case of unilateral international transactions (i.e., transactions that are not related to the acquisition of goods or services) where the sender or receiver holds a Brazilian PayPal account, such transactions are limited to the amount of US$10,000.00 per transaction (or the equivalent amount in other foreign currencies).
International payments may be subject to taxation by the Brazilian authorities. Check the applicable taxation before completing an international payment. You have the option to pay for the acquisition of products and/or services in installments if such possibility is enabled by the seller.
Key information regarding your payments will be provided to you by email and your transaction history will also be updated and made available in your account. You can also access a downloadable report from your PayPal account.
When you send payments with PayPal, you do not pay a fee to PayPal. If the payment requires currency conversion, a currency conversion fee may apply. Your credit or debit card issuer may also charge a separate fee to send or receive payments through your PayPal account. PayPal is not responsible for any fees charged to you by your credit or debit card issuer or any other financial institution.
When PayPal identifies a potentially high-risk transaction, PayPal may place a hold on the transaction and notify the seller to delay shipping the product. As a buyer, this may delay your receipt of the purchased product. If PayPal clears the transaction, it will notify the seller and direct them to ship the product. If the transaction is not cleared, PayPal will cancel it and return the funds to you, unless it is legally required to take other action.
Some sellers allow you to use PayPal as a payment method to make future and/or recurring purchases on their websites, allowing you to complete the purchase more quickly. Typically, this involves creating an agreement with the seller that allows them to ask us to charge your PayPal account each time you make a purchase. Please refer to the Agreement for more details.
PayPal Purchase Protection will benefit the buyer who meets the eligibility requirements set forth in the Agreement, in the cases of Product Not Received (buyer did not receive the product paid for using PayPal) and Product Significantly Not As Described (the product received differs significantly from the description provided by the seller at the time of purchase). You may have to return the product as part of the resolution of your complaint and you will not be entitled to a refund of the return shipping costs you may incur.
If the seller presents evidence that it delivered the products to your address, PayPal may decide in favor of the seller in the event of a claim for a Product Not Received, even if you have not received the products.
PayPal will not refund the return shipping costs you will incur to return a Product Significantly Not As Described to the seller or to third parties PayPal may specify.
Please refer to the Agreement for items that do not qualify for a refund under PayPal Purchase Protection. If you are unable to resolve a problem directly with the seller, log in to your PayPal Account and go to the Resolution Center to open a dispute according to the procedure indicated in the Agreement.
If you and the seller are unable to reach an agreement, you may turn the Dispute into a Claim, according to the procedure indicated in the Agreement. PayPal will make a final decision in favor of the buyer or seller, both of whom must abide by it. PayPal may require the presentation of receipts, third-party evaluations, police reports, or any other document and/or information that PayPal deems necessary.
If you refund a transaction, we will retain the fees you paid as set out on our Fees page.
As a seller, you agree not to impose a surcharge or any other fee for accepting PayPal as a payment method. You may charge a handling fee associated with the sale of products and/or services, provided that such fee does not act as a surcharge and is not higher than the handling fee you charge for non-PayPal transactions.
You, the seller, agree to provide equal treatment to PayPal's payment methods or brands in relation to other payment methods or brands that you offer at your points of sale (for example, websites or mobile applications).
Sellers must publish a privacy policy when required by law.
If PayPal determines that a transaction is high risk, it will place a hold on the payment and notify you to delay shipping the product. If the payment is completed, PayPal will notify you to ship the product. Otherwise, PayPal will cancel the payment and the amounts will be returned to the buyer, unless PayPal is legally obliged to take other action. As a seller, you may accept payments from a buyer's account through pre-authorized transfers under the terms of the Agreement.
Payments received by sellers may later be reversed if they are subject to chargeback, cancellation, a claim, or are otherwise invalidated. The seller is liable to PayPal for the full amount of the payment received, plus any applicable fees, in case such payment is subsequently invalidated for any reason. Please refer to the Agreement to understand when payments may be invalidated and reversed, as well as when the chargeback fee will apply.
If you are a marketplace, PayPal may require you to provide information about the final recipients of funds, in accordance with applicable regulations and flagging rules, and you must submit the information within the deadline requested by PayPal. In the event of a breach of this obligation, PayPal may rescind the Agreement without notice. In addition, if you suspect that a seller is engaged in fraudulent activities, deceptive and/or abusive practices or other activities that may be related to money laundering or terrorist financing, or any other illegal activity, or that violates the Agreement and/or the PayPal Acceptable Use Policy, you agree to take the steps set forth in the Agreement.
You can also choose to receive international payments. In this case, a currency conversion will be required, which is why the exchange rate will be determined based on the rates available on the market, and PayPal will apply the Currency Conversion Fee to the exchange rate. PayPal will make available the corresponding amount of the transaction in Brazilian Reais, net of fees. For each international payment you receive, PayPal will provide you with a summary of the transaction, including the identification of the transaction, its date, the fees, and other information required by applicable regulations. In the case of unilateral international transactions (i.e., transactions that are not related to the acquisition of goods or services) in which the sender or receiver holds a Brazilian PayPal account, such transactions are limited to the amount of US$10,000.00 per transaction (or the equivalent amount in other foreign currencies).
It is your responsibility to determine which taxes are levied on the payments you make or receive through PayPal's services, as well as to provide any and all declarations to the competent authorities, including but not limited to the Central Bank of Brazil and the Federal Revenue of Brazil, for example, related to the receipt of amounts arising from exports or imports of products or services. Remember that you, the buyer, may be subject to withholding taxes and/or other tax obligations with respect to the importation of goods or services from a foreign entity (seller located abroad).
Payments of all fees related to PayPal services are made for their net amounts, free of any taxes or other deductions or withholdings, which shall be made by you, in accordance with the legislation of Brazil in force at the time of the payments.
It is your responsibility to pay any import and/or export taxes (as applicable).
PayPal may request that you provide your CPF or CNPJ number and/or other tax-related documentation or information. If you do not provide PayPal the requested information or documentation, you understand and agree that you may be subject to account limitations and withholding tax at the applicable rates on gross payments received. PayPal will send such withholding taxes to the appropriate tax authorities and cannot refund those amounts.
Check the PayPal fees page for applicable fees. PayPal may change the fees applicable to future transactions you process using PayPal. PayPal will notify you at least 30 days in advance of any fee increase or introduction of a new fee. Once you have access to any account statement or other account activity information made available by PayPal, you will have 60 days to notify PayPal in writing of any errors or discrepancies regarding the prices or other fees applied by PayPal as set forth in the Agreement.
PayPal Seller Protection is available for eligible payments, pursuant to the Agreement, received by sellers who meet the eligibility requirements set forth in the Agreement and is applicable in the event of claims, chargebacks, or cancellations based on an Unauthorized Transaction or Product Not Received. Please refer to the Agreement to check which products and transactions are not eligible for PayPal Seller Protection.
If PayPal determines that you, the seller, had an excessive number of claims, chargebacks, or reversals during a given period, you may become ineligible for PayPal's Seller Protection. If your account's number of claims, chargebacks, or cancellations subsequently decreases, you may become eligible for PayPal Seller Protection again.
PayPal users may not engage in any of the restricted activities listed in the "Restricted Activities" section of the Agreement.
PayPal may, pursuant to the Agreement, take such action as it deems necessary if it believes that you are engaged in restricted activities, such as terminating the Agreement, closing, suspending, or limiting your PayPal account or PayPal services, putting a hold on any balance held in your account if you have a Balance Business Account, as well as suspending your eligibility for the PayPal Purchase Protection program and/or the PayPal Seller Protection program, contacting buyers who have purchased products or services from you using PayPal, your bank or credit card issuer, other impacted third parties, or the authorities about your actions, updating inaccurate information you have provided to us, or taking legal action against you.
If you violate the Acceptable Use Policy, in addition to being subject to the action described in the Agreement, you will be required to indemnify PayPal for the amount of damages suffered as a result of each violation. PayPal may deduct the amount corresponding to your indemnification directly from any existing balance in any Balance Business Account controlled by you or deduct it from any future payments you receive in any Personal or Premier Account.
You are responsible for all cancellations, chargebacks, claims, fees, fines, penalties and other obligations incurred by PayPal, a user, or third parties as a result of your breach of the Agreement and/or your use of PayPal Services.
Under certain circumstances, PayPal may take action related to your account in a general way or to a specific transaction. Please refer to the Agreement for more information about account limitations, holds, or reserves. PayPal's decision on holds, limitations, and reserves may be based on confidential criteria in accordance with applicable law and/or that are essential to our management of risk and the protection of PayPal, our customers, and/or service providers.
If PayPal is notified of a court order or other legal process affecting you, or if it believes it needs to do so to comply with applicable laws or regulatory requirements, PayPal may be required to take certain actions, including placing a hold on payments to/from you, placing a reserve or limitation on your PayPal account, or releasing your funds. You will be notified of such actions unless stipulated otherwise in a court order, applicable law, or regulation.
If you believe your PayPal login information has been lost or stolen, please contact PayPal Customer Service immediately. Tell us if you believe that an electronic fund transfer has been made without your permission using your login information or by other means. Refer to the Agreement for more information.
You agree that PayPal and its affiliates may contact you by email for marketing purposes. You may opt out of receiving marketing communications when you open a PayPal account by changing your account preferences at www.paypal.com.br or by clicking the unsubscribe link in any PayPal email or receipt you receive from us. We will provide you with information about your account or PayPal Services, even if you have opted out of receiving marketing communications. If you provide us with your mobile phone number, you agree that PayPal and its affiliates may contact you at that number, using automatically dialed or prerecorded calls or text messages to provide services to you in connection with your PayPal account, investigate or prevent fraud, or collect a debt. Refer to the Agreement for more details, including changing your account settings.
You understand and agree that, to the extent permitted by law, PayPal may, without prior notice, monitor or record telephone conversations that you or anyone acting on your behalf has with PayPal or its agents for quality control and training purposes or for our own protection, as well as to comply with applicable law or regulations.
If you owe an amount to PayPal, PayPal may deduct the amounts owed from any credit you may have against PayPal or any future payments that you receive. If you have more than one PayPal account, PayPal may offset the amount you owe to PayPal in one account using payments you receive in your other PayPal accounts. In addition, if you are responsible for any amount owed to PayPal or its affiliates, PayPal may debit your PayPal account to pay any overdue amounts.
You must indemnify PayPal for actions related to your PayPal account and your use of PayPal services, as well as for any claim or demand from any third party due to your breach of the Agreement, improper use of PayPal services, your violation of any law or rights of a third party, and/or the actions or omissions of third parties to whom you grant permissions to use your PayPal account.
In no event shall we, our parent companies, subsidiaries and affiliates, our directors, board members, agents, joint ventures, employees, service providers, or suppliers, in Brazil or abroad, be liable for lost profits or any special, incidental, or consequential damages (including, without limitation, damages due to loss of data or loss of business), arising out of or in connection with our websites, software, systems (including networks and servers used to provide any PayPal services) operated by us or on our behalf, any PayPal services or the Agreement (regardless of their origin, including negligence), unless and to the extent prohibited by law. Our liability to you or any third parties is limited, under all circumstances, to the actual value of the direct damages suffered.
In addition, to the extent permitted by applicable law, PayPal is not liable, and you agree not to hold PayPal liable, for any damages or losses resulting directly or indirectly from: (1) your use of, or inability to use, our websites, software, systems operated by us or on our behalf or any PayPal services; (2) delays or interruptions in our websites, software, systems operated by us or on our behalf and any PayPal services; (3) viruses or other malicious software obtained from accessing our websites, software, systems operated by us or on our behalf or any PayPal services or any website or service linked to our websites, software or any PayPal services; (4) glitches, bugs, errors, or inaccuracies of any kind in our websites, software, systems operated by us or on our behalf or by any PayPal services or in the information and graphics obtained from them; (5) the content, actions, or omissions of third parties; (6) a suspension or other action taken with respect to your PayPal account; or (7) your need to modify your practices, content, or behavior, or your loss or inability to do business, as a result of changes to this user agreement or PayPal policies.
PayPal has no control over the products or services purchased through PayPal services and cannot guarantee that a paying user or receiving user with whom you are dealing will in fact complete the respective transaction or be authorized to carry it out.
PayPal will make reasonable efforts to ensure that requests for electronic debits and credits involving bank accounts, debit cards, credit cards, and check issuances are processed in a timely manner, but PayPal makes no representations or warranties regarding the period necessary to complete processing, because PayPal's services depend on many factors beyond its control, such as delays in the banking system or the postal service.
If a dispute arises between you and PayPal regarding PayPal's services, you can contact Customer Service online through the PayPal Help Center, or by calling 0800 047 4482, any day of the week, 24 hours a day. If you are not satisfied with the solution provided by PayPal Customer Service, you may contact the Ombudsman, from Monday to Friday, from 9am to 6pm, by calling 0800 047 4224 (you must have the protocol number reported by PayPal Customer Service to contact the Ombudsman).
You must comply with all terms and conditions set forth in the Agreement relating to the: (i) granting by PayPal of a license to access and/or use its programs, as well as comply with the implementation and access requirements and use restrictions contained in the documentation accompanying the PayPal services made available to you; (ii) granting by you of a license to use your content and associated intellectual property rights and publicity rights, (iii) granting by the seller of the right to use/display its trademarks; and (iv) intellectual property.
If you do not make any payment transaction using your PayPal account for more than 30 days, PayPal may disable the balance functionality of a Balance Business Account or close any type of PayPal account (in accordance with the Agreement). You authorize PayPal, directly or through third parties, to verify your identity and the information provided by you, under the terms of the Agreement. Applicable laws and regulations may require PayPal to verify certain information/documents if you use certain PayPal services. PayPal reserves the right to close, suspend, or limit access to your PayPal account and/or PayPal services if you do not provide information to confirm your identity or other necessary information.
If you integrate or otherwise reference PayPal services on your website, PayPal may use automated technologies (e.g., website crawling) to assess your website and collect any publicly accessible or available data to ensure compliance with this agreement and to combat malicious or fraudulent activity. In connection with such technologies, PayPal will not collect any of your customer personal data. However, there may be times we collect personal data about you that you publish on your websites. Such personal data shall be processed for the purposes described in this section and shall be subject to our Privacy Statement.
By entering into the Agreement, you also acknowledge that, pursuant to article 7, item II, of Law No. 13,709, of August 14, 2018, PayPal may share your personal data to comply with legal or regulatory obligations, including, but not limited to, those arising from Joint Resolution No. 6, of May 23, 2023, and any other applicable regulation.
If you receive information about another user through PayPal services, you must keep it confidential and use it only with respect to PayPal services. You may not disclose or distribute any of a user's information to third parties or use such information for marketing purposes unless you have such user's express consent to do so. You may not send unsolicited emails to a PayPal customer or use PayPal to receive payments for sending unsolicited emails to third parties.
To the extent that you (as a seller) process any personal data relating to a PayPal user in accordance with the Agreement, you and PayPal will each be an independent data controller (and not joint controllers), which means that each will separately determine the purposes and means of processing such personal data. You agree to comply with the requirements set forth in the Agreement and any applicable data protection and privacy laws or regulations.
